Terms of sale

These terms govern any order placed on bestmobilecanada.ca. By finalizing your purchase, you acknowledge having read and accepted them without reservation.

1. Seller identification

The bestmobilecanada.ca site is operated by BestMobileCanada inc., a joint-stock company incorporated under Quebec's Business Corporations Act (NEQ: 1171545529), whose head office is located in Quebec City, Canada.

2. Products offered

BMC sells pre-owned smartphones (iPhone, Samsung Galaxy, Google Pixel and related brands), along with associated accessories. Each device has undergone professional reconditioning in our Quebec City workshop, including a 32-point diagnosis, the replacement of defective components, and thorough cleaning.

The specifications (model, storage, color, cosmetic grade, battery health, included accessories) are described on each product page. Photographs are shown for reference only.

3. Prices and taxes

All prices are shown in Canadian dollars (CAD), before taxes. Applicable taxes (GST, QST, HST or PST depending on the province of delivery) are calculated and displayed before the order is confirmed. BMC reserves the right to change prices at any time; the applicable price is the one in effect at the time the order is validated.

In the event of an obvious pricing error (for example an iPhone shown at $50 instead of $500), BMC reserves the right to cancel the order and issue a full refund.

4. Placing an order

The order becomes firm and final once we send the email confirmation. A sales contract is then formed between you and BMC under articles 1385 et seq. of the Civil Code of Québec.

BMC may refuse or cancel an order for legitimate reasons, including: out of stock, suspected fraud, payment failure, or shipping address outside Canada.

5. Payment

Payments are processed by PayPal (Canada) Co., PCI-DSS Level 1 certified. We accept Visa, Mastercard and American Express via the PayPal gateway, as well as direct payment from a PayPal account. Payment is charged at the time the order is confirmed.

In the event of attempted fraud, BMC reserves the right to request a piece of identification before shipping, or to cancel the transaction.

6. Shipping

Orders are shipped from Quebec City, Canada. The exact terms (fees, lead times, carriers) are described on the Shipping & returns page. The lead times stated are estimates and do not engage BMC's liability for carrier-related delays.

The risk of loss or damage to the product is transferred to the customer upon delivery. In case of a damaged or missing parcel at delivery, the customer must notify us within 48 hours.

7. Right of return and refund

Change-of-mind return. Under our commercial policy you have 30 days from receipt to return your order even without a stated reason (change of mind, impulse buy, wrong model). The device must come back in a condition comparable to delivery, with all accessories provided and no additional wear. Return-label costs are borne by the customer in this case — you pick the carrier. The full refund of the product and taxes is processed within 5 business days following receipt and inspection of the return, to the original payment method.

Return for a warranty-covered defect. If the device shows a defect covered by the commercial warranty (see section 8), BMC provides the prepaid return label. No return-shipping cost to you in that scenario.

Customized products, products unboxed and used beyond normal verification, or returned without accessories, may be subject to reasonable administrative fees communicated before processing. These terms do not affect the consumer rights provided by Quebec's Consumer Protection Act.

8. Commercial warranty

BMC offers a commercial warranty of 3 months (90 days) on all of its pre-owned phones, covering material defects (battery below 80% capacity, screen, charging port, manufacturing defects). On a covered defect, BMC provides the prepaid return label. Full conditions are available on the Warranty page.

This commercial warranty is in addition to, and does not replace, the legal warranty of quality provided by articles 37 and 38 of Quebec's Consumer Protection Act, as well as the warranty against latent defects provided under articles 1726 et seq. of the Civil Code of Quebec.

Best Price Guarantee — warranty extension. When BMC doubles a competitor's warranty under its Best Price Guarantee, the total coverage (initial BMC warranty + match-derived extension) is capped at a maximum of 12 months from the purchase date, regardless of the warranty length offered by the competitor. This cap applies only to the extended commercial warranty and does not affect the legal warranties mentioned above.

9. Liability

BMC makes every effort to ensure that the information on the site is accurate and up to date. However, BMC cannot be held liable for minor typographical errors, temporary site unavailability, or indirect damages (loss of data, loss of business, loss of opportunity).

BMC cannot be held responsible for a failure to fulfill its obligations resulting from a case of force majeure within the meaning of article 1470 of the Civil Code of Québec.

10. Intellectual property

All content on the site (texts, images, graphics, logo, trademarks) is the exclusive property of BMC or its partners. Any reproduction, in whole or in part, without BMC's prior written authorization, is strictly prohibited.

The iPhone, Apple, Samsung, Galaxy, Google, Pixel and other trademarks mentioned on the site are the property of their respective owners. BMC is not affiliated with these manufacturers.

11. Personal data

The processing of personal information collected as part of an order is governed by our Privacy Policy, compliant with applicable Canadian privacy laws (PIPEDA).

12. Governing law and jurisdiction

These terms are governed exclusively by the law in force in Quebec, without regard to conflict-of-law rules. Any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the courts of the judicial district of Quebec, Province of Quebec, Canada.

13. Mediation and OPC

In case of an unresolved dispute, the Quebec consumer may contact the Office de la protection du consommateur (Quebec Consumer Protection Office) at opc.gouv.qc.ca, or use the Arbitration and Mediation Program for vehicles and electronic devices offered by certain accredited organizations.

14. Changes

BMC may modify these terms at any time. The applicable version is the one in effect at the date of the order. Any substantial change will be signaled by a notice on the site.
